Any commercial relationship with SuiteDSP, including the provision and use of its advertising technology and related services, shall be established separately and governed by the relevant contractual documentation.

SuiteDSP reserves the right to determine the scope, content and presentation of the Website and to update or modify its content from time to time.

Such content includes, without limitation, text, articles, descriptions, graphics, photographs, illustrations, designs, layouts, logos, trademarks, trade names, videos, software, visual elements and other materials made available on the Website.

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable and revocable right to access and view the Website and its content for lawful informational purposes.

Nothing in these Terms transfers any intellectual property rights to you or grants any license except for the limited right to use the Website as expressly described above.

All rights not expressly granted under these Terms are reserved by SuiteDSP and its licensors.

Any third-party names, trademarks, logos or other materials appearing on the Website remain the property of their respective owners and may be subject to separate rights and restrictions.

5. Website Content and Information

SuiteDSP makes reasonable efforts to ensure that the information published on the Website is accurate and up to date. However, we do not guarantee that all information is complete, accurate, current or free from errors or omissions.

The Website may include descriptions of technologies, products, features, capabilities, industry developments or other information that may change over time. Such descriptions are provided for general informational purposes and may not reflect the latest developments, specifications or commercial terms.

Nothing on the Website constitutes legal, financial, technical or other professional advice, nor should it be relied upon as a substitute for obtaining advice appropriate to your particular circumstances.

You are responsible for independently assessing the relevance and suitability of any information obtained through the Website before relying on it or making decisions based on it.

SuiteDSP reserves the right to correct inaccuracies, update information, remove content or otherwise modify the Website at any time.

6. Website Availability and Security

SuiteDSP aims to maintain the availability and proper functioning of the Website but does not guarantee that the Website will be available at all times, operate without interruption or be free from technical errors.

Access to the Website may be temporarily restricted or interrupted due to maintenance, updates, technical issues, security incidents, infrastructure failures or circumstances beyond our reasonable control.

To the extent permitted by applicable law, SuiteDSP shall not be responsible for interruptions, delays or unavailability resulting from circumstances beyond its reasonable control.

We may implement technical and organizational measures intended to protect the Website and its infrastructure. However, we do not guarantee that the Website will be completely secure or free from vulnerabilities, malicious components or other technical risks.

You are responsible for using appropriate security measures when accessing the Website, including maintaining the security of your devices and software.

7. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, services or resources for informational or convenience purposes.

Such links do not imply that SuiteDSP endorses, approves of or is affiliated with the relevant third party, unless expressly stated otherwise.

SuiteDSP does not control third-party websites and is not responsible for their content, availability, accuracy, security, products, services or privacy practices.

Your access to and use of third-party websites or services are subject to the applicable terms and policies of those third parties. You access such websites and resources at your own discretion and risk.

Any questions, claims or disputes relating to third-party products, services or content should be directed to the relevant third party.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Website and all information and content made available through it are provided on an “as is” and “as available” basis.

SuiteDSP makes no representations or warranties, whether express, implied or statutory, regarding the Website, including, without limitation, any warranties as to accuracy, completeness, availability, reliability, suitability for a particular purpose or non-infringement, to the extent such warranties may lawfully be excluded.

SuiteDSP does not warrant that the Website will meet your expectations or requirements, operate uninterrupted or error-free, or that any defects will be identified or corrected.

Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited under applicable law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SuiteDSP shall not be liable for any indirect, incidental, special, exemplary or consequential loss or damage arising out of or in connection with your access to or use of, or inability to access or use, the Website.

This includes, to the extent permitted by applicable law, loss of profits, revenue, business opportunities, anticipated savings, data, goodwill or business interruption, whether such loss arises in contract, tort or otherwise, and whether or not SuiteDSP was advised of the possibility of such loss.

To the maximum extent permitted by applicable law, SuiteDSP shall not be responsible for any loss or damage arising from:

  • reliance on information published on the Website;

  • temporary unavailability, interruption or malfunction of the Website;

  • errors or omissions in Website content;

  • third-party websites, services or resources linked to the Website; or

  • unauthorized access to or interference with the Website caused by third parties, except to the extent attributable to a failure by SuiteDSP for which it is liable under applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for intentional misconduct where it cannot lawfully be excluded or limited.

These Terms do not affect any mandatory rights or remedies available under applicable law.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless SuiteDSP, its affiliates and their respective directors, officers, employees and representatives against third-party claims, losses, liabilities, damages and reasonable costs, including reasonable legal fees, to the extent arising directly from your unlawful use of the Website, your material breach of these Terms or your infringement of the intellectual property or other rights of a third party in connection with your use of the Website.

SuiteDSP shall not be entitled to recover under this Section to the extent that the relevant loss or damage results from its own acts or omissions for which it is responsible under applicable law.

11. Suspension and Restriction of Access

SuiteDSP reserves the right to restrict, suspend or discontinue access to the Website, in whole or in part, where reasonably necessary for security, maintenance, legal compliance or the protection of the Website and its users.

We may also take appropriate measures where we reasonably believe that a person has violated these Terms, engaged in unlawful activity or interfered with the proper functioning or security of the Website.

Where reasonably practicable and appropriate in the circumstances, SuiteDSP may provide notice of a restriction or suspension. However, prior notice may not be possible where immediate action is necessary to address a security risk, legal requirement or other urgent matter.

Any restriction or suspension under this Section shall not affect rights or obligations that have already accrued, subject to applicable law.

12. Amendments to These Terms

SuiteDSP may amend or update these Terms from time to time to reflect changes in the Website, our business practices, applicable law or other relevant circumstances.

The updated Terms will be published on the Website together with a revised “Last Updated” date. Unless otherwise stated or required by applicable law, the updated Terms shall take effect upon publication.

We encourage you to review these Terms periodically to remain informed of any changes.

Your continued use of the Website following the effective date of updated Terms constitutes acceptance of those changes to the extent permitted by applicable law.

13. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-law rules.

Any disputes arising out of or in connection with these Terms or your use of the Website shall be submitted to the competent courts of Poland, subject to any mandatory jurisdictional rules applicable under applicable law.

Nothing in this Section shall exclude or restrict any mandatory rights or protections that cannot lawfully be excluded or restricted.

14. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable by a competent court or authority, that provision shall be interpreted or modified to the minimum extent necessary to make it valid and enforceable, where legally possible.

If such interpretation or modification is not possible, the relevant provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.

15. No Waiver

Any failure or delay by SuiteDSP in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy.

Any waiver shall be effective only to the extent expressly given and shall not constitute a waiver of any other right or remedy or of the same right or remedy on any subsequent occasion.

16. Entire Agreement

These Terms constitute the agreement between you and SuiteDSP solely in relation to your access to and use of the Website and supersede any previous terms or understandings relating specifically to that subject matter.

These Terms do not replace or amend any separate agreement governing the provision or use of the SuiteDSP platform or other services provided by SuiteDSP. In the event of any inconsistency, the relevant separate agreement shall govern the contractual relationship to which it applies.
